$903,000.00 jury verdict for hand injuries
When a hospital's motorized slide retrieval machine
started up on its own, a file clerk's hand became caught inside,
causing partial amputation of one finger and a crushing-type injury
to another.
Timothy J. Brunnock, Esq., demonstrated to
an Essex County jury that the injuries were caused by the company
that manufactured and serviced the machine, and that the injuries
the woman sustained were permanent in nature. The jury awarded a
total of $903,000, as reported in The Star Ledger and The New Jersey
Law Journal.
"We were able to show the jury just how devastating
these injuries were to a young, single working woman," Mr. Brunnock
said, notwithstanding the manufacturing company's contention that
it was "just a broken finger.
$450,000.00 settlement in stolen car/uninsured
motorist case
A woman making deliveries in a snack food truck
was broadsided by a stolen vehicle as the driver attempted to elude
police in Bergen County. The woman sustained serious injuries, including
a fractured leg and severe skin abrasions, resulting in multiple
surgeries. Brian P. Fleming, Esq. obtained a settlement of
$450,000 on behalf of the woman from Allstate Insurance Company,
her automobile insurance carrier.
Jury awards $212,000.00 despite insurance
company's claim of "soft tissue injuries"
A man injured in a motor vehicle accident sustained
injuries to his lower back which prevented him from working as a
glass installer. When the insurance company for the negligent driver
refused to settle the case, maintaining that the injuries were "soft
tissue in nature", Brian P. Fleming, Esq., tried the case
before a Passaic County jury.
The jury returned a verdict of $212,000.
Young horse bite victim receives structured
settlement of $271,000.00
A three year old Chester, New Jersey boy had one
of his fingers on his dominant hand partially bitten off by a neighbor's
horse while being cared for by a baby sitter. Timothy J. Brunnock
settled the case prior to trial which resulted in a structured settlement
that will ultimately payout $271,825.28 to the infant.
$475,000.00 settlement during trial
A woman seriously injured in a January 1991 motor vehicle accident in New York City turned to Brunnock & Fleming for help in 1998.
Her case had been dormant in the New York court system for over six years, when Brian P. Fleming and Michele Mordkoff took over the case from her former attorney.
The woman sustained injuries resulting in multiple back surgeries, but the insurance company for the negligent driver denied responsibility, claiming that a subsequent accident was the cause of her injuries. Based on this contention, the insurance company refused to make an offer of settlement.
Brian and Michele tried the case before a Brooklyn, New York jury. The case settled after four days of trial for $475,000.00.
